Terms of Use

1. General provisions

These Terms of Use (the “Terms”) regulate relations between IP Morev Valentin Valentinovich (the “Operator” or “we”) and the user (“you” or the “User”) in connection with the use of the “Shkiper AI” mobile and web application (the “Service”). Registration or any other use of the Service constitutes your full and unconditional acceptance of the Terms.

The Terms constitute a public offer in accordance with Article 437 of the Civil Code of the Russian Federation. If you disagree with any clause — stop using the Service.

2. Description of the Service

“Shkiper AI” is an educational service that provides access to an AI tutor for preparation for yachting certification exams (ISSA, RYA, IYT). The Service includes:

• An AI assistant that answers questions based on certified textbooks.
• A library of topics covering exam programmes.
• Mock exams in a format close to real school tests.
• Diagrams, schemes and supporting materials.
• Progress tracking and a spaced-repetition system.

3. Educational nature of the materials — IMPORTANT

The materials and AI answers in the Service are for educational and reference purposes only. They DO NOT replace training with a certified instructor, on-water practice, and they are not professional advice on real navigation and maritime safety.

The User fully accepts responsibility for applying the obtained knowledge in real navigation, vessel handling and crew safety. The Operator bears no liability for any consequences arising from the use of Service materials in real conditions, including navigational mistakes, on-water incidents, property damage and harm to health.

AI answers may contain errors, outdated information or incomplete data. All safety-critical decisions must be based on current official sources (COLREGs, charts, weather forecasts, vessel-manufacturer manuals) and consultations with qualified specialists.

4. Pricing and payment

The Service offers free and paid plans:

• Free (₽0): access to 3 topics, up to 10 AI questions per day, one trial mock exam.
• Course Pass (₽1,490, one-time): full access to all topics of one exam (e.g. ISSA Coastal Skipper), unlimited questions, all mock exams, offline access. Validity — 12 months from purchase.
• Monthly (₽599/mo): full access to all courses and levels, auto-renewing monthly until cancellation.
• Annual (₽2,990/yr): full access to all courses, auto-renewing yearly until cancellation, savings vs the monthly plan.

Payment is made via YooKassa, the Apple App Store or Google Play providers depending on the platform. Prices include VAT. The Operator reserves the right to change prices, with notice to active subscribers at least 30 days before the new price applies on the next renewal.

5. Refunds

The refund policy depends on the plan and payment channel:

• Monthly and Annual: refund within 7 calendar days of payment if the User has not made significant use (defined as fewer than 20 AI questions and fewer than one mock exam).
• Course Pass: non-refundable after activation, as it provides immediate full access to the content. Refund is only possible in case of technical inability to provide the service.
• Purchases via App Store / Google Play: governed by the policies of the respective platforms. Contact Apple or Google support directly.

To request a refund issued via YooKassa, write to hello@shkiper.app with a description of the situation. The refund is issued within 10 working days.

6. Usage rules

The User undertakes to:

• Provide accurate registration data.
• Not share account credentials with third parties and not use a single account for commercial purposes (e.g. teaching paid-school students without a separate partner agreement).
• Not attempt reverse engineering, decompilation or breaking of protection mechanisms.
• Not use automated tools (bots, parsers, scrapers) to extract Service content.
• Not use the Service to build competing products.
• Not place in the AI chat unlawful, abusive, pornographic content, calls to violence, or spam.

Violations are grounds for blocking the account without refund of the unused part of the subscription.

7. Intellectual property

All rights to the Service, including the source code, design, content structure and the “Shkiper AI” trademark, belong to the Operator. The educational materials used to generate AI answers are used under licences or as fair educational use. The User receives a limited, non-transferable, revocable licence for personal non-commercial use of the Service.

8. Limitation of liability

The Service is provided “as is”. The Operator does not guarantee:

• Uninterrupted operation of the Service (planned and emergency maintenance is possible).
• Absolute accuracy of all AI answers.
• Successful exam results from using the Service — outcomes depend on many factors including effort and practice.

The Operator’s maximum aggregate liability to the User is limited to the amount paid by the User for use of the Service over the last 12 months.

9. Termination

You may stop using the Service at any time by deleting the account in the app settings or by writing to hello@shkiper.app. The Operator may block the account in case of gross or repeated violations of the Terms.

10. Governing law and dispute resolution

The Terms are governed by the law of the Russian Federation. All disputes are resolved through negotiation; if no agreement is reached — at the court at the Operator’s location. Consumer rights under the Russian Federation Law “On Consumer Rights Protection” are preserved for consumer users.

11. Changes to the Terms

The Operator may update the Terms. Substantial changes are announced at least 14 days before they take effect via email and/or in-app notifications. Continued use of the Service after changes take effect constitutes acceptance of the new version.
